NMBConnect Online Terms And Conditions
Proceeding to use NMB Bank Limited Platform is confirmation that the Client would have accepted the below Terms and Conditions

DEFINITIONS

"the Account" Any account held by the Bank in the name of the Connect Customer and/or on which the Customer is authorised to operate through the use of the Connect facility.
"NMB Connect Online" A banking delivery channel that uses the Internet Technology.
"NMB Connect App" A banking delivery channel that uses the mobile Technology.
"the Bank" NMB Bank Limited.
- Words importing one gender include the others. - the singular include the plural and vice versa.
The headings to the paragraphs shall not be used for the purpose of interpretation thereof. These terms and conditions (the “Terms”) govern your access to and use of NMB Connect app and NMB Connect online and any products and services of whatever nature (whether existing now or in the future) available through the Platforms (the “Services”).

ACCEPTANCE

Acceptance by the Connect Customer of these Terms and Conditions shall take place on the customer's electronic acceptance and in the event that the customer has not accepted these terms, access to the Connect service shall not be granted.

DEED USE OF CONNECT ONLINE

The customer is obliged to apply for cancellation if he no longer wishes to use Connect Services (and if such notification is oral immediately thereafter to confirm the notification in writing) or if he/she knows or reasonably suspects that his/her Connect password has been compromised. Until he cancels the service or makes such notification, which the Bank shall acknowledge, all requests made, instructions given and transactions initiated through the use of the Connect shall be deemed to have been made, given or initiated (as the case may be) by the Connect Customer and the Bank is irrevocably authorised to act on and give effect to all such requests, instructions and transactions and to debit the Account with the amount of all payments and disbursements initiated through as well as all charges, duties, levies imposed in respect of the use of the Connect facility and recover all such amounts, charges, duties and levies from the Customer.

LOSSES

The Bank, its officers and servants, shall not be responsible or accountable to the Connect Customer for any loss or damage, actual or contingent, arising from or out of the use of the Connect facilities.

TERMINATION AND RESTRICTION OF CONNECT FACILITY USE

The Bank may at any time, without prior notice, terminate or restrict the Connnect Customer’s use of the Internet Bank facility (a) if compelled to do so by law; or (b) if there is reason to believe that the account is being used for any illegal purposes.

CHARGES

Charges imposed by the Bank from time to time shall be payable by the Connect Customer for the provision of the Connect facilities, whether or not the Connect facility is being used during the period concerned. Applicable transaction charges and or taxes shall be levied on all instructions received through the Connect facility.

ALTERATIONS AND CONDITIONS

The Bank may amend these Terms and Conditions at any time after notice or authorization as and if required by law. If no notice or authorization is required by law, your continued access and use of the NMB Connect facility after the effective date of such change will constitute your acceptance of and agreement with such amendment(s). No oral agreement between the Bank and the Connect Customer to alter these Terms and Conditions shall be of any force or effect.

ACCEPTANCE

Acceptance by the Connect Customer of these Terms and Conditions shall take place on the customer's electronic acceptance and in the event that the customer has not accepted these terms, access to the Connect service shall not be granted.

OTP (One Time Password)

Functionality
The following functionality is available:
• Maintain the cell phone number/ Email for your OTP delivery option.
• Change OTP delivery option from an email address to cell phone number for yourself.
• Change OTP delivery option from a cell phone to an email address for yourself.
Where can you maintain OTP delivery preferences?
• Update via Branch
You can visit your nearest NMB Bank branch for assistance with changing your OTP details. Please take your ID/Passport with you as a form of verification.
Important Notice about OTP preferences
• To update your OTP Preferences via Branch you must have your new cell phone number and you must still be receiving your OTP notifications on your old cell phone number. • This functionality is restricted to the Prime User (Profile Customer).

LOANS

• I understand that the Bank may review my loan facility periodically and that the Bank may at any time, by notice to me at the residential address given overleaf, suspend my loan facility and/or require my immediate settlement of all amounts outstanding to my loan and overdrawn current account, inclusive of all accrued interest.
• In the of any default by me, including failure to make an instalment due on time, the bank shall be entitled without notice, to demand immediate payment of sums required to cover my existing and contingent liability to the Bank whether or not such sums are immediately due and payable and in addition to decline me any further facilities.
• I understand that I must not exceed the loan and/or overdraft limit agreed to by the Bank.
• I understand that my salary shall be paid through my current account during the currency of the loan and that diversion / cessation of the salary will render the outstanding loan amount plus accrued interest, immediately payable.
• In the event that the Bank incurs any legal expenses in recovering the amount due to it under this loan facility, the Bank shall be entitled to recover such legal costs from me on a legal practitioner and client basis, together with any collection charges which may be levied by its legal practitioners. I give the Bank authority to set-off the outstanding loan balance and accrued interest, against any credit balances that may be sitting in any of my other accounts held with the Bank
• Any sums which remain unpaid beyond the agreed dates of payment or any outstanding sums which have become immediately due by virtue of demand by the Bank shall be subject to a penalty interest rate of 80% per annum. The said penalty interest rate is subject to change as advised by the Bank, in writing, from time to time.
• I agree that the Bank may collect, use and disclose their credit data as provided in this agreement and/ or obtained by the Bank in accordance with the Access to Information and Protection of Privacy Act (Chap 10:27). • I understand that the Bank will charge interest on the outstanding debit balance on my loan calculated at 60% per annum and that the said interest will accrue on a daily basis.
• I agree to pay a drawdown fee, charged at 6% on the gross amount I will have borrowed.
• I authorise the Bank to immediately deduct 1% per year of the gross loan amount towards Insurance. I understand that the Bank will take out an Insurance, which is binding on me and which I may examine at the Bank’s Head Office on request.
• I choose domicilium citandi et executandi at the residential address shown above and hereby submit myself to the jurisdiction of the courts of Zimbabwe in any dispute arising from this document, notwithstanding that, at the time of that proceedings are commenced, I am domiciled outside Zimbabwe.

SMS ALERTS TERMS AND CONDITIONS

• The following terms and conditions shall apply to all NMB Bank SMS Alerts Service customers.
• Definitions: In these Terms and Conditions, the following terms shall have the following meanings: Customer: The applicant of this service is hereunder referred as "Customer’” Bank: NMB Bank is herein after referred as "Bank” Service: The NMB Bank SMS Alerts Service is herein after referred as "Service”
•The customer shall abide and be bound by the instruction and/or procedures of the Bank.
• While NMB Bank will take the due care to make this service available at all times but in the unlikely event of any reasons which are beyond Bank's control, including but not limited to any technical difficulty, which results in outage of the services and/or loss of any transmission, of messages, then NMB Bank is not liable.
• The customer hereby irrevocably agrees to hold free and harmless the Bank and indemnify the Bank against all actions, claims, demands, liabilities, losses, damages, costs and expenses of whatever nature that may result due to the Bank providing the service.
• The Client hereby indemnifies the Bank from any liability including claims for damages that may arise in the event that the Bank erroneously communicates with client with regards to any credit or debits on client's accounts.
• The Bank will transmit the NMB Bank SMS Alerts notifications on time to the Service Provider but the delivery of the data to the Subscriber's equipment depends on the Service Provider locally and abroad and the Bank cannot be held responsible for non-receipt or erroneous data received or receipt of the messages at odd times and the consequences arising there from.
• The Bank is not liable for any breach of confidentiality of any data/information sent to the Subscriber's equipment. The Customer acknowledges that he/she is solely responsible for protecting his/her mobile phone/device and privacy.
• In case of change/disconnection/loss of Customer's mobile phone number(s) or equipment, the Customer undertakes to notify the Bank in writing immediately of such instance to protect the interest of all parties. The Subscriber shall indemnify the Bank for all loss or damage on account of Customer's failure to notify the Bank of the change/disconnection of Subscriber's mobile phone Number(s).
• The Customer agrees that the Bank has the right to withdraw any or all of the facilities under the service, without reason, at any time after serving a notice to the Subscriber by ordinary post or via message to the Customer's equipment.
• The Customer agrees that the Bank shall levy a charge for the service and hereby agrees to pay the charges/fees for use of any or all of the NMB Bank's SMS Alerts Service.

E-STATEMENT TERMS AND CONDITIONS

Electronic Statement Agreement
This agreement sets forth the terms and conditions of NMB Bank Limited e-statement service. In the agreement, the words “you” and “yours” means authorised accountholders who complete the attached application. The words “we”, “us” and “our” mean NMB Bank Limited. By completing and signing the attached application, you agree to all of the terms and conditions of this agreement.
Electronic Statement Content
We will e-mail your monthly account statement to the e-mail address provided on the attached application. The e-mail will contain your encrypted statement.
Software Requirements
Your statement will be attached to the email as an Adobe PDF file. You must have a current version of Adobe Reader installed on your computer to open your statement. You can download the current version of Adobe Reader for free from http://www.adobe.com.
Delivery Security
Prior to delivery, we will secure your statement using encryption. Encryption involves scrambling data so unauthorised parties cannot decipher it. It is important to ensure that your statement remains secure as it is passed from us to you. We will only deliver your statement to an address indicated in the attached application or an updated address provided by an authorised accountholder.
Access Security
You must use your “Statement Password” to open the statement file which will be attached to the e-mail. The password you indicated on the application must be six (6) to ten (10) characters in length and contain any combination of upper/lowercase letters and/or numbers. We encourage you to use a combination of these characters, which decreases the likelihood of an unauthorised party guessing your password.
Archive Security
You can save the statement file on your personal computer or file server. The file will remain encrypted and you must use your “Statement Password” to open the file. We encourage you to consider additional security measures, such as limiting access to authorised accountholders, to protect your account information from unauthorised parties who may know your “Statement Password”.
Notices
You may contact the Bank regarding this agreement or your e-statement service by visiting any of our branch locations. We will contact you regarding this agreement or your e-statement service by e-mail to the address used to deliver your periodic statement or by regular mail to the address on the account statement being sent through the e-statement service.
• The Bank is not liable for any breach of confidentiality of any data/information sent to the Subscriber's equipment. The Customer acknowledges that he/she is solely responsible for protecting his/her mobile phone/device and privacy.
Enrolment
Once you enrol for this service, existing and new current and savings accounts for which you are a primary customer will automatically be enrolled in this service.
Fees
Currently there are no fees charged for electronic delivery of your e-statements. We reserve the right to impose or change fees for electronic delivery and charge your deposit account for these fees at any time.
Procedure to Terminate Electronic Delivery
You have the right to terminate your election to receive electronic statements at any time as described in this section. Electronic delivery may not be terminated for individual accounts - termination will apply to all accounts enrolled. To discontinue receiving your account statements electronically, contact us. Electronic delivery will be discontinued for all accounts that were enrolled.
Amendment and Termination
We may amend or change this Agreement at any time after notice or authorization as and if required by law. If no notice or authorization is required by law, your continued acceptance of e-statements after the effective date of such change will constitute your acceptance of and agreement with such amendment(s). We may terminate this Agreement, immediately refuse or revoke access to e-statements at any time, including but not limited to in the event that we or you terminate any deposit account, without cause or notice or refund of previously charged or accrued fees, as applicable.
Limited Liability
You agree that we will not be liable for lost profits or any special, incidental or consequential damages arising from or in connection with your use of our e-statement. Further, you agree that we will not be liable for any technical, hardware or software failure of any kind, any interruption in the availability of our e-statement service, any delay in operation or transmission, any incomplete or illegible transmission, computer virus, loss of data, or other similar loss
The terms and conditions contained herein shall be governed and interpreted in accordance with the laws of Zimbabwe.
ALL APPLICANTS
I/We agree that the Bank reserves the right to close my/our account compulsorily without warning if it is unsatisfactorily conducted. I/We also certify that the above statements in support of my/our application for an account are true and complete, and understand that in the event of any information proving to be inaccurate, this application may be declined. In the event of an account being opened for me/us, I/we agree to abide by the terms and conditions of the account.
NOTICE:
NMB Bank Limited will never send you an e-mail requesting you to enter your personal details or private identification and/or authentication details.
